March 5, 2019:
The Fremont County Board of Supervisors met in regular session on Tuesday, March 5, 2019, in the Fremont County Courthouse Boardroom, with Graham, Hickey, and Sheldon present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted.
Let the records show that Sandy Parmenter with the Valley News Today was present for this meeting.
Motion by Hickey to approve the contract with Midwest Data Center, Inc. to run fiber from Hamburg to Sidney for the ISICS Radio Project. Motion carried unanimously.
County Attorney Naeda Elliott met with the board regarding storage space and the reconfiguration of her office. They are trying to go paperless, but they need storage space for current records. Also, they have three desks in their current office and at times they have five people. They would like to look in to using the magistrate’s office or that is currently not being utilized. Motion by Hickey to allow the county attorney to explore space options and move forward. Motion carried unanimously.
Dee Owen, Auditor, presented the board with the levy information on the board-controlled drainage districts. The board reviewed the information and motion by Sheldon to leave the levy rates as they were last year. They will consider Johnson Run at 10:00 a.m. on a conference call with Page County.
Engineer Dan Davis met with the board for two signings:
Motion made by Hickey to allow Chairman Graham to sign Farm to Market transfer of funds for construction materials inspection costs on Project #STP-S-CO36(70) - - 5E-36. Motion carried unanimously.
Motion made by Hickey to allow Chairman Graham to sign Farm to Market transfer of funds for construction materials inspection costs on Project #STP-S-CO36(65) - - 5E-36. Motion carried unanimously.
Safety Coordinator Jeff Shirley met with the board regarding his job description. He would like clarification for his job title as discussed in January. The board has asked County Attorney Elliott to look in to clarifying his job description. The discussion was what the board would like to see from him. County Attorney Elliott will consult with Jack Reed with INCS and create a job description. Sheldon commended Shirley on his job performance.
Motion was made Sheldon to allow Chairman Graham to sign GAX fund request for payment under CDBG for the Iowa Watershed Approach Project. Motion carried unanimously.
Motion was made by Hickey to sign Wellmark Insurance renewal forms. The county remains on Plan 9 through ISAC which the same plan in years past. Motion carried unanimously.
Susan Shepherd stopped in to visit with the board to update them on the progress of the Tabor Library. The Lakin Foundation approved $680,000 toward their $1.7 million goal. They already had $400,000 on hand. They would still like a letter of support from the board and any amount of financial assistance the board can commit.
Randy Schaeffer briefly visited with the board about the ISICS Radio System.
At 10:18 a.m., Supervisor Graham phoned the Page County Board of Supervisors called in to discuss and set the levy rate for Johnson Run Drainage District. Page County would like to see no levy until they spend down some of their balance. Motion by Hickey that there is no levy for Johnson Run for the coming year. Motion carried unanimously.
Claims were approved for March 8, 2019.

The Fremont County Board of Supervisors met in regular session on Tuesday, March 12, 2019, in the Fremont County Courthouse Boardroom, with Graham, Hickey, and Sheldon present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted.
Let the records show that Sandy Parmenter with the Valley News Today was present for this meeting.
Troy Housh, Maintenance, met with the board requesting approval of the Lawn World contract renewal. He presented a plan that included a 5-step plan for fertilizer and treatment of grubs. There is a cost savings for paying it up front in lieu of making payments. Hickey moved to approve the Lawn World contract. Motion carried unanimously.
Motion by Sheldon to appoint Susan Shepherd to the vacant At-Large SWIPCO Board position. Motion carried unanimously.
Motion by Sheldon to appoint Earl Hendrickson to the vacant At-Large SCIA Board position. Motion carried unanimously.
Assistant Engineer Robbie Kromminga met with the board for the signing of a work in ROW permit for Windstream Communications, LLC to place copper cable at 220th Street and 195th Avenue to existing pedestal at 1994 220th Street. Motion by Hickey to allow Chairman Graham to sign the permit. Motion carried unanimously.
Motion made by Sheldon to recess until 10:00 a.m. when the board will reconvene for the budget public hearing. Motion carried unanimously.
At 10:01 a.m., motion made by Hickey to re-open the meeting. Motion carried unanimously.
At 10:01 a.m., motion was made by Hickey to go into public hearing. A public hearing for adoption of the 2019/2020 Fremont County Budget was held. Present were Supervisors Terry Graham, Randy Hickey, Dustin Sheldon, and Auditor Dee Owen. Also present was Sandy Parmenter from the Valley News Today. At 10:04 a.m., hearing no objections, motion was made by Hickey to close the public hearing and pass the following resolutions to approve the FY 2019/2020 Fremont County Budget. Motion carried unanimously.
WHEREAS, the Fremont County Compensation Board meets annually to recommend a compensation schedule for elected officials for the fiscal year immediately following, in accordance with Iowa Code Chapters 331.905 and 331.907, and
WHEREAS, the Fremont
County Compensation Board met on December 12, 2018, and made the following
salary recommendations for the following elected officials for the fiscal year
beginning July 1, 2019:

RESOLUTION FOR APPROPRIATIONS
WHEREAS, it is desired to make appropriations for each of the different officers and department for the fiscal year beginning July 1, 2019, in accordance with Section 331.434, Subsection 6, Code of Iowa.
THEREFORE, be it resolved by the Fremont County Board of Supervisors on this 12th day of March, 2019, the following:
1. The amounts itemized by fund and department on the attached schedule are hereby appropriated from the resources/funds as shown.
2. Subject to the provisions of other county procedures and regulations, and applicable state law, the appropriations authorized under number 1 shall constitute an authorization for the department/officer listed to make expenditures or incur obligations from the itemized fund, effective July 1, 2019.
3. In accordance with 331.437, Code of Iowa, no Department/Officer shall incur any liability in excess of the amount appropriated to this resolution.
4. If, at any time during the 2019/2020 budget year the Auditor ascertains that the available resources of a fund will be less than said fund’s total appropriations, he/she shall immediately inform the Board and recommend appropriate corrective action.
5. The Auditor shall establish separate accounts for the appropriations authorized in number 1. The Auditor shall report the status of such accounts to the applicable Departments/Officers monthly during the 2019/2020 budget year.
6. All appropriations authorized pursuant to this resolution lapse at the close of business on June 30, 2020. The above and foregoing resolution was adopted by the Fremont County Board of Supervisors on Tuesday, March 12, 2019.
The Fremont County Board of Supervisors, meeting in session on this 12th day of March, 2019, do hereby resolve to appropriate the amounts itemized by department for the fiscal year 2019-20.

The Fremont County Board of Supervisors met in emergency session on Monday, March 18, 2019, in the Fremont County Courthouse Boardroom, with Graham, Hickey, and Sheldon present. A quorum was declared, and the meeting officially called to order at 4:03 p.m. The agenda was approved as posted.
Also present for this meeting was Assistant County Attorney Tyler Loontjer.
Motion made by Hickey to approve the following resolution:
RESOLUTION PROCLAIMING A COMPREHENSIVE SCHEDULE OF CIVIL PENALTIES FOR VIOLATIONS OF MANDATORY EVACUATION AND MANDATORY CURFEW PROVISIONS
WHEREAS, Fremont County, Iowa, including both incorporated and unincorporated areas thereof, is currently experiencing flooding of historic proportions; and
WHEREAS, the Governor of Iowa has proclaimed a state of disaster emergency in Fremont County due to said flooding and related consequences therefrom;
WHEREAS, Fremont County may, pursuant to its home rule authority, exercise any power and perform any function it deems appropriate to protect and preserve the rights, privileges and property of the county and/or of its residents, and to preserve and improve the peace, safety, health, welfare, comfort, and convenience of its residents; and
WHEREAS, the Fremont County Board of Supervisors has determined that it is necessary to order the mandatory evacuation of, and order mandatory curfews for, certain areas of unincorporated Fremont County in order to protect or preserve life and property; to assist in disaster mitigation, response, and recovery; and to generally preserve and improve the peace, safety, health, welfare, comfort, and convenience of its residents.
NOW, THEREFORE BE IT RESOLVED by the Fremont County Board of Supervisors that due to the current flooding in Fremont County, Iowa, where there is proclaimed to be a civil emergency, in which the Chairman of the Board of Supervisors has responded, and may further respond, by issuing Orders of Mandatory Evacuation for any part of unincorporated Fremont County the Chairman deems advisable as necessary to protect or preserve life and property; to assist in disaster mitigation, response, and recovery, this order shall be made in writing and communicated in such a manner as to reasonably apprise the affected residents and the general public of the specific location of the areas to be evacuated and shall indicate the date and time by which the said areas shall be evacuated; and
BE IT FURTHER RESOLVED that ingress and egress to and from an area subject to an Order of Mandatory Evacuation shall be limited to authorized law enforcement, emergency management personnel, and other authorized government officials; and
BE IT FURTHER RESOLVED that the Chairman of the Board of Supervisors, may issue an Order of Mandatory Curfew for any part of unincorporated Fremont County the Chairman deems advisable as necessary to protect or preserve life and property; to assist in disaster mitigation, response, and recovery; or as necessary to otherwise carry out the purposes of this ordinance; and
BE IT FURTHER RESOLVED that any such Order of Mandatory Curfew shall be in writing, communicated in such a manner as to reasonably apprise the affected residents and the general public of the specific times and locations of the curfew, and shall indicate the date and times in which said curfew shall be in effect; and
BE IT FURTHER RESOLVED that exemptions to the curfew order shall be limited to authorized law enforcement, emergency management personnel, and other necessary government officials and those individuals authorized and/or directed by law enforcement, emergency management personnel, and other authorized government officials; and
BE IT FURTHER RESOLVED that it shall be the duty of the County Sheriff to administer and enforce this resolution in accordance with its provisions; and
BE IT FURTHER RESOLVED that the penalties for violating the provisions of this resolution shall be as set forth hereinafter:
WHEREAS, the Fremont County Board of Supervisors met on March 18, 2019, to consider and approve said Schedule of Civil Penalties.
NOW, THEREFORE, BE IT RESOLVED BY THE FREMONT
COUNTY BOARD OF SUPERVISORS
The Fremont County Board of Supervisors hereby adopt the following Schedule of Civil Penalties:
Civil Penalties Authorized for Violation of
Mandatory Evacuation Order or Order for Mandatory Curfew
A violation of an Order for Mandatory Evacuation, or an Order for Mandatory Curfew, may result in a county infraction, punishable by civil penalties in the amount of Seven Hundred Fifty Dollars ($750.00) for the first offense and One Thousand Dollars ($1,000.00) for a second or subsequent offense.
Said Resolution becomes effective upon passage, approval and publication as provided by law.

The Fremont County Board of Supervisors met in regular session on Tuesday, March 19, 2019, in the Fremont County Courthouse Boardroom, with Graham, Hickey, and Sheldon present. A quorum was declared, and the meeting officially called to order at 9:01 a.m. Minutes of the previous board sessions were read and approved. The agenda was approved as posted.
Also present for this meeting were Sandy Parmenter with Valley News Today, Jerry and Sandra Moores, Steve Meyer, Casey Moyer, and Bill Clark.
Casey Moyer from Fremont County Landfill met with the board regarding the bonds they would like to issue. The bids for their project came in under what was expected. Motion by Sheldon to allow the landfill to move ahead with the bond process. Motion carried unanimously.
Sandra Moores discussed the condition of the impound lot. She believes that it meets all the criteria of a nuisance property. She discussed trespassing, noise at all hours of the night, and run-off flammables, noise and congestion during auctions. She also discussed a junk trailer that was hauled there after being removed from another property in the city as it was declared a nuisance. Moores knows at this time the county is in crisis and would just like to see the trailer moved for now then maybe work on the other items when things have calmed down in the county. The board stated they will look in to other options for the impound lot.
Motion by Sheldon to approve the following new hires for the sheriff’s office. Motion carried unanimously.

Engineer Dan Davis met with the board regarding his 2020 IDOT Secondary Roads Budget and 5-Year Program. Davis discussed the various roads in need of repair due to the flooding and winter conditions and the funding for these projects. Motion by Hickey to approve the 2020 Secondary Roads Budget and 5-Year Program. Motion carried unanimously.
Davis also discussed SF184 and presented a resolution for signing regarding this Senate File. The forestry industry would like to raise the load weight for all roads. Davis explained the consequences that this could have on the roads in Fremont County. Motion by Hickey to sign the resolution opposing SF 184. Motion carried unanimously.
FREMONT COUNTY BOARD OF SUPERVISORS
A RESOLUTION OPPOSING SENATE STUDY BILL1045 AND SENATE FILE 184 PASSED BY THE SENATE COMMITTEE ON TRANSPORTATION
WHEREAS, the Transportation Committee in the Iowa Senate has passed House Study Bill 1045 (SF 184) which would amend and make changes to Iowa Code Chapter 321 related to transportation of indivisible loads and raw forestry products on primary and non-primary highways, and;
WHEREAS, Fremont County owns and maintains nonprimary highways, and is fiscally and legally responsible for the nonprimary highways within the County, and;
WHEREAS, Fremont County owns and maintains 127 structures classified as bridges by the National Bridge Inspection Standards, and;
WHEREAS, many of the bridges owned by Fremont County are aging and structurally deficient or functionally obsolete, and;
WHEREAS, current funding is not adequate to replace or rehabilitate these bridges at the rate their conditions are deteriorating, and;
WHEREAS, the nonprimary roads and bridges owned by Fremont County serve a critical need for residents, agricultural users, businesses, schools, post offices, and emergency responders, and;
WHEREAS, the proposed bill would allow the Iowa Department of Transportation to issue annual permits to forestry industry haulers for loads up to 130,000 pounds on nonprimary highways throughout Iowa, without knowledge of or notice given to the agencies which own these highways and the structures thereon, and;
WHEREAS, bridges within Fremont County have been designed for loads that were legal on Iowa roads at the time of their construction, and bridges have only been rated or posted with weight restrictions for loads that are currently legal on roads, and;
WHEREAS, each bridge within Fremont County is unique based on its age, design, and current condition, and;
WHEREAS, load rating to ensure safe passage of loads greater than 80,000 pounds would be unique for each load on each individual bridge, and;
WHEREAS, the traversing of Fremont County bridges by loads up to 130,000 pounds without the County being afforded the knowledge of or the ability to restrict each occurrence, would result in gradual and possibly sudden failure of bridges within the County, and;
WHEREAS, Fremont County would likely bear legal and financial liability for subsequent failure of its bridges, even if such failures are caused by loads they did not permit, and;
WHEREAS, Fremont County is not financially able to repair or replace bridges which would be subject to accelerated deterioration by increased loads, and;
WHEREAS, Fremont County and its residents, farmers, businesses, schools, post offices, and emergency responders, would be subjected to undue operational and economic hardships by further degradation of its road system and the structures thereon;
THEREFORE BE IT RESOLVED, that the Fremont County Board of Supervisors strongly urges all Iowa lawmakers to vote in opposition to this legislation.

March 20, 2019:
The Fremont County Board of Supervisors met at the Emergency Operations Center for a flood briefing on Wednesday, March 20, 2019, with Graham, Hickey, and Sheldon present. A quorum was declared, and the meeting began at 4:48 p.m. Some items discussed were lifting of evacuation order in Thurman, Red Cross Shelter being moved from Hamburg to Sidney, the conditions of the livestock in the hog barns on the bottom, railroad bridges and county bridges that are damaged in the county, Jersey Barriers for J-18, counseling for flood affected persons, and what will happen when people are allowed to return to residences. The meeting concluded at 5:38 p.m.

March 21, 2019:
The Fremont County Board of Supervisors met in emergency session on Thursday, March 21, 2019, in the Fremont County Courthouse Boardroom, with Hickey present and Sheldon present by telephone. Graham was not present for this meeting. A quorum was declared, and the meeting officially called to order at 1:45 p.m. The agenda was approved as posted.
Also present for this meeting were County Attorney Tyler Loontjer, EMC Mike Crecelius, John Travis, and Iowa Homeland Security Dustin Pogones.
The board discussed a resolution setting policy and procedure for re-entry to the mandatory evacuation area. Motion made by Hickey to approve the following resolution. Motion carried unanimously.
RESOLUTION SETTING POLICY AND PROCEDURE
FOR RE-ENTRY TO THE MANDATORY EVACUATION AREA
WHEREAS, Fremont County, Iowa, experienced significant flooding from the Missouri River requiring orders of mandatory evacuation from certain unincorporated areas of the county; and
WHEREAS, flooding within certain mandatory evacuation areas has subsided sufficiently to allow re-entry to certain homes and businesses.
NOW, THEREFORE, BE IT RESOLVED by the Fremont County Board of Supervisors that the following procedures shall be followed by those person(s) or business(es) re-entering areas no longer designated as part of the mandatory evacuation area:
1. Prior to occupancy of the residence or business the owner shall contact the Fremont County Emergency Management to determine if an inspection is necessary and schedule an inspection of the premises. If property is serviced by a well and/or a septic system, the owner shall also contact Fremont County Environmental Health to determine if an inspection is necessary and schedule the inspection.
2. If the property has had uninterrupted electrical service and has potable water and sanitary system, absent substantial structural damage that makes occupancy unsafe, the owner, after inspection, if the inspection is necessary, may re-enter the property.
3. If electrical service had been temporarily discontinued, power may be re-established to the property per guidelines as set forth by Mid-American Energy or Atchison Holt Electric Co-op once an inspection has been done. Once electrical service has been established and if the home has an operational water and sewer/septic, absent substantial structural damage that make occupancy unsafe, the owner may re-enter the property.
4. If after inspection, electrical service may not be re-established and/or the property does not have potable water and sanitary system, the property owner may only enter the property during daylight hours for the purposes of making sufficient repairs to establish the necessary utilities. Once sufficient repairs are made, the property owner shall contact Fremont County Emergency Management and/or Fremont County Environmental Health to determine occupancy.
5. If after inspection it is determined that there is substantial structural damage as determined by applicable building codes, the owner may not occupy the property and may only enter the property during daylight hours to make such repairs as necessary to allow for occupancy.
6. Any costs associated with inspections or permits required for repair may be subject to reimbursement or waiver upon application to the Fremont County Board of Supervisors or State of Iowa.
7. The above conditions are also applicable to those person(s) or business(es) that have remained on his/her property during the evacuation period.
8. Appropriate county departments and offices shall coordinate and prepare an information packet for affected property owners.

The Fremont County Board of Supervisors met in regular session on Tuesday, March 26, 2019, in the Fremont County Courthouse Boardroom, with Graham, Hickey, and Sheldon present. A quorum was declared, and the meeting officially called to order at 9:01 a.m. Minutes of the previous board sessions were read and approved. The agenda was approved as posted.
Also present for this meeting were Sandy Parmenter with Valley News Today, Cara Morgan with Golden Hills RC & D, Rick Wilson with JEO, Safety Coordinator Jeff Shirley, and Engineer Dan Davis.
Rick Wilson with JEO met with the board regarding a task order approval. This is an environmental services task order. It allows them to go ahead with the 404 permitting. The cost is $7500.00. There are 10 sites on the East Nishnabotna and all of these depend on the project. Motion made by to Hickey to allow Chairman Graham to sign the task order. Motion carried unanimously.
Engineer Dan Davis met with the board regarding two signings.
Motion made by Hickey to allow Chairman Graham to sign a permit for Jerico Services, Inc. as dust control suppliers for Fremont County for 2019. Motion carried unanimously.
Engineer Davis presented an emergency repair contract with Western Engineering for J-18 in Randolph. This is ER Site No. 1. They will remove the south side of the pavement, construct the shoulder, and compact it. This qualifies it as a Federal Aid project. The total is $163,654.00. With the board’s approval, they would like to start today. Motion made by Hickey to allow Chairman Graham to sign the emergency repair contract. Motion carried unanimously.
Motion by Sheldon to table the safety coordinator job description until next week. Motion carried unanimously.
The board discussed changing dental carriers for 2019/2020. Auditor Owen presented pricing from Delta Dental and the renewal costs from Blue Dental. Delta Dental is less expensive for equal coverage. Motion made by Hickey to change carriers for 2019/2020. Motion carried unanimously.
Motion made by Sheldon to approve the renewal of the Special Class C Liquor License Beer/Wine for D & L Pro. Motion carried unanimously.
The board received notice that Banker’s Trust has been bought out by UMB Bank. UMB requested a signed notice of assignment for this change. Motion by Hickey to allow Chairman Graham to sign the notice of assignment. Motion carried unanimously.
Motion by Hickey to sign letter of engagement for bond counsel with Ahlers & Cooney for the landfill bond. Motion carried unanimously.
Motion by Hickey to sign a resolution fixing date for meeting on the proposition to authorize a loan agreement and the issuance of notes to evidence the obligation of the County thereunder. The following is a roll call vote. Graham, aye; Hickey, aye; Sheldon, aye.

RESOLUTION FIXING DATE FOR A MEETING ON THE AUTHORIZATION OF A LOAN AGREEMENT AND THE ISSUANCE OF NOT TO EXCEED $825,000 GENERAL OBLIGATION CAPITAL LOAN NOTES OF FREMONT COUNTY, STATE OF IOWA (FOR ESSENTIAL COUNTY PURPOSES), AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF
WHEREAS, it is deemed necessary and advisable that Fremont County, State of Iowa, should provide for the authorization of a Loan Agreement and issuance of General Obligation Capital Loan Notes, to the amount of not to exceed $825,000, as authorized by Sections 331.402 and 331.443, of the Code of Iowa, for the purpose of providing funds to pay costs of carrying out essential county purpose project(s) as hereinafter described; and
WHEREAS, the Loan Agreement and Notes shall be payable from the Debt Service Fund; and
WHEREAS, before a Loan Agreement may be authorized and General Obligation Capital Loan Notes issued to evidence the obligation of the County thereunder, it is necessary to comply with the provisions of the Code of Iowa, as amended, and to publish a notice of the proposal and of the time and place of the meeting at which the Board proposes to take action for the authorization of the Loan Agreement and Notes and to receive oral and/or written objections from any resident or property owner of the County to such action.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF FREMONT COUNTY, STATE OF IOWA:
Section 1. That this Board meet in the Board Room, County Courthouse, 506 Filmore Street, Sidney, Iowa, at 9:30 A.M., on the 16th day of April, 2019, for the purpose of taking action on the matter of the authorization of a Loan Agreement and issuance of not to exceed $825,000 General Obligation Capital Loan Notes, for essential county purposes, the proceeds of which notes will be used to provide funds to pay the costs of improvements and extensions to the landfill facilities of the Fremont County Sanitary Landfill Commission.
Section 2. The Auditor is authorized and directed to proceed on behalf of the County with the negotiation of terms of a Loan Agreement and the issuance of General Obligation Capital Loan Notes, evidencing the County's obligations to a principal amount of not to exceed $825,000, to select a date for the final approval thereof, to cause to be prepared such notice and sale information as may appear appropriate, to publish and distribute the same on behalf of the County and this Board and otherwise to take all action necessary to permit the completion of a loan on a basis favorable to the County and acceptable to the Board.
Section 3. That the Auditor is hereby directed to cause at least one publication to be made of a notice of the meeting, in a legal newspaper, printed wholly in the English language, published at least once weekly, and having general circulation in the County. The publication to be not less than four clear days nor more than twenty days before the date of the public meeting on the issuance of the Notes.
Section 4. The notice of the proposed action to issue notes shall be in substantially the following form:

PUBLIC NOTICE is hereby given that the Board of Supervisors of Fremont County, State of Iowa, will hold a public hearing on the 16th day of April, 2019, at 9:30 A.M., in the Board Room, County Courthouse, 506 Filmore Street, Sidney, Iowa, at which meeting the Board proposes to take additional action for the authorization of a Loan Agreement and the issuance of not to exceed $825,000 General Obligation Capital Loan Notes, for essential county purposes, to provide funds to pay the costs of improvements and extensions to the landfill facilities of the Fremont County Sanitary Landfill Commission. Principal and interest on the proposed Loan Agreement will be payable from the Debt Service Fund. At the above meeting the Board shall receive oral or written objections from any resident or property owner of the County to the above action. After all objections have been received and considered, the Board will at the meeting or at any adjournment thereof, take additional action for the authorization of a Loan Agreement and the issuance of the Notes to evidence the obligation of the County thereunder or will abandon the proposal to issue said Notes.
