July 2015
July 7, 2015:
The Fremont County Board of Supervisors met in regular session on Tuesday, July 7, 2015, in the Fremont County Courthouse Boardroom, with Hickey, Hendrickson and Morgan present. A quorum was declared and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted.
Motion was made by Hickey to table any decision on a new tourism board member until they could see if a female mayor would be interested in serving on the board. The code dictates the best criteria for the new tourism board member would be a female mayor.
Mike Crecelius, EMC, met with the board to discuss the EMPG Grant. Crecelius said the Feds released figures for next year’s EMPG Grant funds. For the next year they will fund $22,811.62, which is a decrease of $1,045.05.
At 10:00 a.m. Hickey made a motion to go into Public Hearing to approve Assignment of Certificate of Purchase at Tax Sale. Hickey, aye; Morgan, aye; Hendrickson, aye. Motion was made by Hendrickson to approve the following Resolutions regarding the Certificate of Purchase at Tax Sale. Hickey, aye; Morgan, aye; Hendrickson, aye.
RESOLUTION APPROVING THE ASSIGNMENT OF CERTIFICATE OF PURCHASE AT TAX SALE TO THE FOLLOWING:
WHEREAS, Charles and Julie O’Barsky, 511 G Street, Hamburg, IA 51640, is desirous of obtaining a certificate of tax sale purchase for $1,165.00 for the following:
Parcel Number 430430228000000 – LOT 3 BLOCK 38, HAMBURG, FREMONT COUNTY, IOWA, according to the recorded plat thereof.
WHEREAS, Fremont County is desirous of avoiding the expense of tax redemption procedure, and
WHEREAS, a public hearing on this proposal was held on the 7th July, 2015 and,
WHEREAS, the transfer of said certificate of tax purchase to Charles and Julie O’Barsky, 511 G Street, Hamburg, Iowa 51640, is in the better interest of the County and is in the better interest of Charles and Julie O’Barsky, Hamburg, Iowa, to eliminate any form of liability to Fremont County, now
THEREFORE, it is hereby resolved that the Chairman of the Board of Supervisors is authorized and directed to execute the assignment of certificates of tax purchases of this real estate upon receipt of payment.
IT IS SO RESOLVED, this 7th, day of July, 2015.

ASSIGNMENT OF CERTIFICATE OF TAX SALE PURCHASE
Fremont County does hereby transfer the certificate of tax sale purchase regarding the described real estate to Charles and Julie O’Barsky, 511 G St., Hamburg, IA 51640 as follows:
Parcel Number 430430228000000 –LOT 3 BLOCK 38, Hamburg, Iowa.
The county shall endorse the tax sale certificate as necessary to complete this assignment upon receipt of payment of $1165.00.

In other business the Treasurer’s Semi-Annual Report was approved. Also approved was the Recorder’s for the month of June.
Claims were approved for July 10th, 2015.
There being no further business, Hendrickson made a motion to adjourn. Motion carried unanimously.

July 14, 2015:
The Fremont County Board of Supervisors met in regular session on Tuesday, July 14, 2015, in the Fremont County Courthouse Boardroom, with Hickey, Hendrickson and Morgan present. A quorum was declared and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted.
Let the records show present for this meeting was, Nick Johansen, Shenandoah Valley News.
Morgan made a motion to cut off Medical Reimbursements on the 28th of August, 2015. Motion carried unanimously.
Motion was made by Hendrickson to reappoint Terry Lewis to the Conservation Board. Motion carried unanimously.
Motion was made by Hendrickson to approve LEC change orders as presented. Motion carried unanimously.
In other business, the Sheriff’s Monthly Report was approved.
At 9:30 a.m. there being no further business, Hendrickson made a motion to adjourn. Motion carried unanimously.

July 21, 2015:
Courthouse Boardroom, with Hickey and Morgan present. A quorum was declared and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted.
Let the records show Hendrickson did not attend this meeting. Others present were Corey Becker, Mike Crecelius, John Travis, Steve Mather, Sandy Parmenter with The Hamburg Reporter and Nick Johansen with Shenandoah Valley News.
Jim Vrbsky, met with the board to discuss property lines, neighbors and the poor condition of his water in Anderson. Mike Crecelius, EMC suggested Vrbsky talk to other people in Anderson, and see if anyone else is interested in having someone come to their house to have their water tested at no cost to them. Corey Becker, County Attorney, reminded Vrbsky that disputes between neighbors is up to the property owners to resolve not the county board of supervisors. As for property lines Becker said the county has to go by county records, and the county is trying to rectify the situation. Supervisors stressed to Vrbsky that they are addressing everything they are able to address.
Mike Crecelius, EMC, presented the results of an Infrastructure Protection Assessments performed by the Iowa Department of Homeland Security and Emergency Management.
Randy Monroe, met with the board requesting a Quit Claim Deed to clear up any misunderstandings on property legally turned over to him. Corey Becker, County Attorney, said he would handle the Quit Claim Deed for him.
Dan Davis, Engineer, met with the board. Motion was made by Morgan to sign payment voucher with HGM Associates for Project #BROS-CO36(68) - -5F-36. Motion carried unanimously.
Motion was made by Morgan to sign payment voucher with HGM Associates for Project #STP-S-CO36(65) - - 5E -36(J-18). Motion carried unanimously.
Motion was made by Morgan to sign payment voucher with HGM Associates for Project #STP-S-CO36(70) - - 5E-36 (J-18 from K-68 East to M-16). Motion carried unanimously.
Howard Vaughn stopped in to visit with the board.
At 10:00 a.m. Morgan made a motion to go into Public Hearing to approve Assignment of Certificate of Purchase at Tax Sale. Hickey, aye; Morgan, aye. With no one from the public to object or comment motion was made by Morgan to approve the following Resolutions regarding the Certificate of Purchase at Tax Sale. Hickey, aye; Morgan aye.

WHEREAS, Fremont County is desirous of avoiding the expense of tax redemption procedure, and WHEREAS, a public hearing on this proposal was held on the 21st July, 2015 and, WHEREAS, the transfer of said certificate of tax purchase to David and Kathryn Hall, 2376 390th Ave., Farragut, IA 51639, is in the better interest of the County and is in the better interest of David and Kathryn Hall, Farragut, Iowa, to eliminate any form of liability to Fremont County, now THEREFORE, it is hereby resolved that the Chairman of the Board of Supervisors is authorized and directed to execute the assignment of certificates of tax purchases of this real estate upon receipt of payment.

July 28, 2015:
The Fremont County Board of Supervisors met in regular session on Tuesday, July 28, 2015, in the Fremont County Courthouse Boardroom, with Hickey, Hendrickson and Morgan present. A quorum was declared and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted.

Morgan made a motion to hire a structural engineer to evaluate the condition of the current jail facility to see if it would be suitable for county offices. The project will be put out for bids. Motion carried unanimously.
Morgan made a motion to approve the following Resolution. Also present was Christy Briley, Cory Becker, Danny Toma and Karen Berry. Motion carried unanimously.
RESOLUTION CONCERNING TIMEKEEPING REQUIRMENTS OF PARTTIME EMPLOYEES
WHEREAS, the Affordable Care Act requires time keeping measures to ensure that all employees who are eligible for health insurance benefits are offered said benefits, action is required to prevent any eligible employee from not being offered health insurance;
BE IT RESOLVED BY THE FREMONT COUNTY BOARD OF SUPERVISORS that all part time employees and employees who are not currently offered health insurance shall keep proper timesheets as prescribed by the County Auditor and submit them to the County Auditor in regular intervals as prescribed by that office. The purpose of this time keeping requirement is to avoid any and all penalties provided for in the Affordable Care Act for not offering health insurance benefits to qualifying employees.

Present were Christy Briley, Auditor Office, Cory Becker, County Attorney, Danny Toma, Custodian, and Karen Berry, Assessor. Becker said the State Auditor is recommending that everyone keeps a timesheet as an accounting aspect. Becker also said he did not think they could ask the Board of Supervisors to require that, saying it has to be up to each individual department to require their staff keep timesheets, saying there is nothing in the code that says you have to. Marker said “the purpose of the state auditor is control, that is exactly what their purpose is” saying they really appreciate their recommendation if that is essential to our county, but she feels there is a point where control becomes micromanagement, and she feels a salaried employee is hired for a job, not hired for the time they put in. Hendrickson said he thinks it is up to each individual, and if he was an employee he would keep a timesheet for his own personal records. Motion was made by Hendrickson that each individual department can keep their own timesheets if they so choose. Morgan asked before voting if that met employees under the supervisor’s supervision are not going to be required to keep time sheets? Hendrickson said no they are not. Motion carried unanimously.
Motion was made by Morgan to approve a three-year Employment Contract and Agreement for the County Engineer as presented. Motion carried unanimously.
Regarding a request for Use of Courthouse Lawn during Rodeo Parade August 1st. Motion was made by Hendrickson to deny the request. His feelings were that if they allowed one person to do it there may be many that want to do the same thing. Motion carried unanimously.
Leo Ettleman stopped in to visit with the board regarding a meeting the following morning. The meeting pertains to a top width widening project the Corp has planned.
At 10:15 a.m. there being no further business, Hickey made a motion to adjourn. Motion carried unanimously.
