Sheriff Kevin Aistrope Reports:
On September 15, 2024 at 14:59, the Fremont County Sheriff’s Office received a call of a disturbance in the 1000 block of Essex, Ave in Farragut. The victim advised she was being assaulted with a baseball bat.
Deputies arrived and placed Sylvia Marie Hayes, age 47 of Farragut, Iowa into custody without incident. The victim was transported to Shenandoah Memorial Hospital with serious injuries.
During the investigation deputies discovered evidence that Hayes intended to kill the victim with the baseball bat.
Hayes is being held on:
Attempted Murder, a Class B Felony
Willful Injury, causing serious injury, a Class C Felony
Going Armed with Intent, a Class D Felony
Domestic Abuse 2nd Degree, an Aggravated Misdemeanor
Hayes is being held without bond, pending initial appearance with a Fremont County Magistrate.

On September 13, 2024, the Fremont County Sheriff’s Office arrested Ronald Dean Boyer, age 81 of Sidney, Iowa for multiple offenses.
Boyer is charged with:
4 counts of Sexual Abuse of a Child 2nd Degree, a Class B Felony
1 count of Sexual Abuse 3rd Degree, a Class C Felony
5 counts of Incest, a Class D Felony
Boyer is being held on a $150,000 cash only bond.

On September 8, 2024, at 07:11, Jared William Rye, age 38 of Plattsmouth, NE was arrested for multiple offenses near the intersection of 210th Avenue and Hwy 2 in Fremont County. Deputies allege Rye rammed a vehicle and then exited his truck while displaying a knife. Rye was placed under arrest with the assistance of the Iowa State Patrol.

In August of 2024, Fremont County Deputies received a report of sexual abuse that occurred beginning in 2015. During the course of the investigation, deputies discovered evidence of sexual abuse against multiple victims. A warrant was issued for Martin, and he turned himself in to the authorities in Fremont County. More charges are pending in the case. Martin is being held without bond, pending initial appearance with the Fremont County Magistrate.

On September 04, 2024 at 08:23, deputies arrested Joshua Lee Painter, age 42, of Lawson, MO for theft, possession of a controlled substance, assault on an officer, and interference with official acts. He remains in custody. Painter was stopped for an equipment violation on Hwy 2 near the Missouri River. Painter, who had an active warrant for his arrest gave the identification information of a relative in an attempt to avoid arrest. However, the relative also had warrants for their arrest. Painter resisted deputies and a struggle occurred, resulting in the deputy receiving minor injuries. Deputies deployed a taser and Painter was taken into custody. The deputy was treated by EMTs at the scene and released back to duty. Painter was taken to Grape Community Hospital and released. Deputies discovered the motorcycle Painter was operating was reported stolen. Painter is being held on $15,000 cash bond.

July 25, 2024 Update 08/09/2024
On August 9, 2024, Elvin Leroy Culley, age 78 and Martha Karen Perry-Culley, age 61 of Hamburg were both arrested in connection to this case. Both were charged with:
- Neglect or Abandonment of a Dependent Person, a Class C Felony
- Child Endangerment. An Aggravated Misdemeanor
Both are being held on $10,000 cash bonds.

Sheriff Kevin Aistrope Reports:
On July 25, 2024 at approximately 0853hrs, the Fremont County Sheriff’s Office received a report of a small child, alone, near the roadway in the 1700 block of Washington Street, Hamburg, Iowa.
Deputies discovered a 4-year-old child, with reported developmental disabilities, covered in filth and a mixture of both human and animal feces outside the residence. Deputies located another child inside the home. Both children were taken to a nearby hospital for evaluation.
Deputies allege that the parents, DUSTIN CARL LEE PERRY, age 26 and LINDSEY BARBARA MARIE HAMILTON, age 26, both of Shenandoah, Iowa, left the children in the care of relatives with the direction to keep the 4-year-old in a makeshift cage.
Deputies located the cage in the home constructed out of a pack and play, a baby gate roof, and zip ties. Deputies allege that the child was able to escape from the device and left the home without waking the occupants.
Deputies discovered a second homemade cage where it is alleged that the child was kept in a walk-in closet in a home in Shenandoah, Iowa.
Both Perry and Hamilton were arrested and charged with:
Neglect or Abandonment of a Dependent Person, a Class C Felony
Child Endangerment. An Aggravated Misdemeanor
Several children were removed from the home by DHS.
Both are being held at the Fremont County Jail without bond, pending initial appearance with Magistrate.
More charges are pending in the case.
Hamburg Rescue, Iowa Department of Health and Human Services, and the Shenandoah Police Department assisted with the investigation.

Sheriff Kevin Aistrope Reports,
On July 29, 2024, at approximately 3:30pm, the Fremont County Sheriff’s Office received a report of a stolen vehicle being chased by the owner, on Hwy 275 near Hamburg.
Deputies responded to the area and observed the vehicle, a silver 2004 Chevrolet Suburban northbound in the 2600 block of Hwy 275. Deputies were able to stop the vehicle and a felony traffic stop was conducted. The driver, TROY DECKER, age 50 of Kingman, Arizona exited the vehicle. Two pit bulls also exited the vehicle and attacked a Fremont County Deputy causing severe injuries. The dogs were secured and DECKER was placed under arrest without further incident.
The Fremont County Deputy, was transported to a local hospital by Sidney Rescue. The deputy was later released and is recovering at home.
The vehicle was reported stolen out of Nebraska City, Nebraska. The license plates on the vehicle were found to be stolen out of Clarinda, Iowa.
DECKER was charged with Theft 2nd, possession of Methamphetamine, and two counts of a possessing a dangerous animal. DECKER is being held at the Fremont County Jail on $6,000 cash only bond. More charges are pending.
The dogs are being held at a local veterinary clinic pending infectious disease results.

Impaired Driving
As Iowans celebrate Independence Day, the Governor’s Traffic Safety Bureau (GTSB) reminds all drivers, No One's a Good DRUNK Driver. In 2022, a person was killed every 39 minutes in a drunk-driving crash on our nation's roads. July 3 through July 7, law enforcement across the state will be on high alert for signs of drunk driving and taking necessary steps to remove these dangers from the road.
Every year, the Fourth of July stands out as one of the deadliest times on Iowa roads. Over the past five years (2019-2023), there have been 32 traffic fatalities during the holiday, with 50% of those being alcohol related.
“If you sense any level of buzz, it is your duty to stay away from the driver's seat. For some people, even one drink is too many to drive safely,” says GTSB Bureau Chief Brett Tjepkes. “Unfortunately, many drivers don’t realize how impaired they are or feel they’re still good to drive after consuming alcohol. That’s why GTSB launched a new campaign this year to remind Iowans, No One’s a Good DRUNK Driver.”
Lots of planning goes into Fourth of July festivities, plan for a sober driver. When a friend has been drinking and is considering driving, be proactive—take away the keys, find a safe ride home, or offer a couch.
The Governor’s Traffic Safety Bureau works with city, county, state, and local organizations to develop and implement strategies to reduce death and injury on Iowa’s roadways using federally funded grants.
There are steps that you can take the will make your trips safer. Driving within the posted speed limits can give you more time to react in an emergency. Wearing your seatbelt will help protect you from an accident.

On June 21, 2024, deputies attempted to stop two sport motorcycles for speeding near Sidney, Iowa. Both motorcycles fled law enforcement reaching speeds over 135 miles per hour in a 55 Mph zone. On May 10, 2024, at approximately 1008 hrs, the Fremont County Sheriff’s Office received a report of a bank robbery that occurred at the First Interstate Bank in Hamburg, Iowa.
At approximately 1000hrs, a white male entered the bank, demanded money, and left the scene on a white Harley Davidson Motorcycle with black saddle bags.
The vehicle was last seen southbound on Hwy 275 near the Iowa/Missouri state line.

On April 21, 2024, deputies arrested Barbara Ann Shryock, age 49 of Council Bluffs, Iowa and Danny Joe Fallin, age 68 of Leon, Iowa for Trespassing and Child Endangerment. Lydia Michelle Wittwer age 21 of Riverton, Iowa was arrested for Child Endangerment.
Deputies were called to an address in Riverton for trespassers attempting to live in a house they did not own that was scheduled for demolition. Deputies allege that a search of the home uncovered a bucket of human waste, soiled diapers, and children’s toys.
Deputies allege that Shyrock and Fallin were living in the home and Wittwer was living nearby but allowing her small child access to the home. The child was found in an unsanitary condition and taken into protective custody by the Iowa Department of Human Services.
Shyrock and Fallin are being held at the Fremont County Jail on $2,000 cash/surety bond. Wittwer was released after posting a $2,000 surety bond.

On April 24, 2024, deputies arrested Andrew Thomas Cowan, age 31 of Malvern for Possession of Marijuana 1st
Offense, OWI 1st Offense, and Carrying a Weapon While Intoxicated.
At approximately 0348hrs, Deputies were called to a one-vehicle accident at the intersection of Hwy 275 and 110th street near Tabor. Deputies allege that Cowan was southbound on Main Street in Tabor and left the roadway striking the ditch at the intersection with 110th Street. Cowan was found to be in possession of suspected marijuana and a firearm. Tabor Fire and Rescue assisted the Fremont County Sheriff’s Office with the call.
Cowen was released after posting a $1,000 surety bond.

On April 22, 2024, deputies arrested Anthony Lee Moyer, age 61 of Sidney, for Assault with intent to Commit Sexual Abuse. It is alleged that on 04/08/2023, Moyer was at a Fremont County business and made sexual comments to the victim as well as pulled on her clothing, struck her buttocks, and kissing her without consent. Moyer was released after posting a $2,000 surety bond.

On April 22, 2024, deputies arrested Timothy Mark Gardner, age 63 of Hamburg, for Operating without Owner’s Consent. Deputies were called to the 2800 block of Bluff Road near Hamburg for a report of a stolen vehicle. The vehicle was later located at the city park. Deputies were able to identify a suspect through surveillance footage, and Gardner was arrested at his residence. Gardner is being held at the Fremont County Jail on $2,000 cash/surety bond

On April 23, 2024, deputies arrested Trista Lee Bensley, age 20 of Des Moines, Iowa for Possession of Drug Paraphernalia. Deputies were called to Cubby’s near Percival for a reported shoplifter. The vehicle was stopped on Interstate 29 near the Pottawattamie County line by the Iowa State Patrol. A search by deputies uncovered drug paraphernalia. The Fremont County Magistrate dismissed the case without prejudice, and she was released pending further charges.

On April 20, 2024, deputies were called to the 600 block of West Street in Tabor for a report of a party where minors were drinking and damaging a neighbor’s property. Prior to the deputies’ arrival, a suspect, Lane Allan Harris, age 19 of Sidney, fled the scene with another person. The investigation was turned over to the Tabor Police Department for further charges.
Deputies later received a call that several males were in a truck stop near Percival, Iowa and told employees that they were running from the police. Deputies contacted the males and Harris was arrested for Possession of Alcohol by a person under the legal age and released with a court date. On 04/23/2024, Harris was arrested for an active Fremont County warrant for Violation of Probation. He was released after posting a $1,000 cash/surety bond. Fremont County Deputies later issued four juvenile citations for Possession of Alcohol by a minor.

On April 24, 2024, deputies with assistance from the Fremont County K9 Unit, arrested Matthew Jeffrey Barnes, age 51 and Serena Ann Scott, age 51 of Omaha, Nebraska in the 2300 block of Hwy 2. Deputies conducted a traffic stop on a non-plated vehicle. During the traffic stop, Fremont County K9 Storm was deployed, and a search of the vehicle uncovered approximately 10 grams of suspected methamphetamine. Barnes was also found to have a felony warrant for his arrest out of Douglas County, Nebraska.
Bares was arrested for Possession with Intent to Distribute over 5 grams, Failure to Affix a Drug Tax Stamp, Possession of a Controlled Substance 2nd Offense, Possession of Marijuana 2nd Offense, Possession of Drug Paraphernalia, and Fugitive from Justice. He is being held on a $100,000 cash/surety bond on the Fremont County charges and without bond on the Nebraska warrant.
Scott was arrested for Possession of a Controlled Substance and Possession of Drug Paraphernalia. Scott is being held at the Fremont County Jail on $1,000 cash/surety bond.

Deputies allege Guthrie woke and then attempted to flee into her home on foot. On 03/06/2024, a Hamburg resident reported a trailer valued at over $6,000 stolen from a business on Main Street. Surveillance footage showed Aldana and an unknown male, stealing the trailer. An arrest warrant was issued for Aldana, and he was arrested in Otoe County, Nebraska and extradited to Iowa. Aldana was released after posting a $10,000 surety bond.

In a 2023 GTSB State Fair survey of over 1,450 Iowans, 51% admitted
to always or sometimes driving with a cell phone in hand. Based on the number of registered drivers in Iowa, that translates to over 1.2 million distracted drivers. Law enforcement is cracking down on distracted
driving. In 2023, over 9,000 drivers were issued citations for illegal use
of an electronic device while driving compared to 1,438 in 2022. *
GTSB is partnering with law enforcement across Iowa April 1-8, to
remind people...No One is a Good Distracted Driver. This
Enforcement effort occurs during April, which is National Distracted
Driving Awareness Month.
In the last several months we have had several major accidents that
have occurred in Fremont County due to distracted driving,
We are also going to be doing projects for impaired driving. So far in 2024 we have arrested twelve intoxicated drivers.
The deputies will also be looking for speeding, seatbelt and other general enforcement violations.

Sidney, Iowa – On March 4, 2024, the Fremont County Sheriff’s Office received a call that an incident had happened at a grain bin site at 2922 120th Street, Tabor, Ia.
It appears that Robert Wayne Smith, Age 94, was helping in a bin unloading soybeans while running a grain vacuum. Smith’s son was out moving the semi that they were loading. When the son came back to the bin Robert was found under the beans.
Smith was pronounced dead at the scene and is being sent to the State Medical Examiners Office in Ankeny to determine the cause of death.
Tabor Fire and Rescue was assisted at the scene by Randolph Fire and Sidney Fire and Rescue

PRESS RELEASE.
With milder weather we will be doing projects with the Iowa State Patrol with the intent of seat belt enforcement. During the projects we will be enforcing general traffic enforcement and looking for s impaired drivers. In the year 23-24 we have had a total of six traffic deaths and six serious injury accidents. Fremont County has had a higher percentage of unbelted traffic deaths per capita, of small counties in Iowa.
We will also be looking for distracted divers. Not just texting or on the phones, but other things that distract, like eating and drinking and not paying attention to the road, to animals in drivers’ laps.

On February 21, 2024, deputies arrested Jonathan Jay Adkisson, age 20 of Sidney, Iowa for Reckless Driving in the 800 Block of Clay Street, Sidney. He was released on a $300 cash bond.

On February 22, 2024, deputies arrested Timothy Clayton Mccollum, age 51 of Coin, Iowa, in the 800 block of Fremont Street, near Shenandoah. On February 24, 2024, deputies arrested Dewight Eugene Binau, age 45 of Sidney, Iowa for Assault on an Officer, Public Intoxication, and Interference with Official Acts at the corner of Webster and Illinois Streets in Sidney. Sidney Rescue assisted the Fremont County Sheriff’s Office on the call. Binau is being held on a $1,000 surety bond.

On January 24, 2024, deputies arrested Tasha Denise Beale, age 45 of Franklin, Virginia at the Fremont County Jail. Beale, who was in jail related to an incident that occurred on 01/20/2024, was arrested for Assault with Injury on correctional officer. It is alleged that Beale assaulted a Sheriff’s Office employee, causing minor injury. She was being held on $7,000 cash/surety bond on the initial incident and $2,000 cash bond on the second incident. Beale was released on 02/15/2024 on time served after a plea of guilty

On January 26, 2024, deputies with the assistance of the Fremont County K9 Unit, arrested Aimee Kay Wright, age 38 of Nebraska City, Nebraska on Interstate 29. Wright was arrested for Possession of Marijuana, Possession of Methenamine, and Possession of Drug Paraphernalia. She was released on bond.

On February 5, 2024, deputies with the Fremont County K9 Unit arrested Joshua Joel Moses, age 47 of Clarinda, Iowa, on Hwy 2 for Child Endangerment, Possession of Drug Paraphernalia, and Possession of a Controlled Substance (Methamphetamine). He was released on bond.

On February 13, 2024 deputies with assistance of the Fremont County K9 Unit, arrested Robert Alan Herzberg, age 45 of Bedford, Iowa and Samantha Danielle Hull, age 34 of Coin, Iowa, near the intersection of Hwy 2 and Bluff Road. Herzberg was charged with Possession of a Controlled Substance and Unlawful Possession of Prescription drugs. Hull was charged with two counts of Possession of a Controlled Substance, Unlawful Possession of Prescription drugs, and Possession of Drug Paraphernalia. Deputies recovered approximately 3lbs of suspected marijuana, and items that field-tested positive for fentanyl and methamphetamine. Herzberg and Hull were both released on a $5,000 cash/surety bond.

The Fremont County Sheriff's Office received 12,003 calls for service in 2023, an increase of 1,193 calls from 2022.
Deputies made 342 arrests in 2023 resulting from 530 criminal charges. Deputies wrote 458 citations and 766 written warnings during the course of 3,115 traffic stops.
The sheriff's office received reports of 289 motor vehicle accidents, resulting in deputies filing 145 accident reports.
